1. About these terms

BumpSlip is provided by BumpSlip Ltd (“we”, “us”). You can contact us at info@bumpslip.com.

These terms apply between us and the school, trust or other organisation that signs up for BumpSlip (“the school”, “you”). The person who signs up confirms that they are allowed to agree to them on the school’s behalf. BumpSlip is a service for organisations, not for consumers.

Our Data Processing Agreement forms part of these terms. If the two conflict on how personal data is handled, the Data Processing Agreement wins.

2. The service

BumpSlip lets school staff record accidents, incidents and illness, lets the school office review and approve those records, and lets the school send a copy to a parent or carer. It includes the website, the staff phone app and the parent copy pages (“the service”).

BumpSlip is a record-keeping tool. It does not give medical advice and does not replace the judgement of trained first aiders or your own first aid, safeguarding and health and safety policies. In an emergency, call 999.

We may improve and change the service over time. We won’t remove a main feature you rely on without telling you at least 30 days in advance.

3. Free trial

New schools can try BumpSlip free for the trial period shown when you sign up. You won’t be charged during the trial. We will email you at least 7 days before it ends.

To carry on after the trial, choose a plan during the trial and give payment details. If you have chosen a plan, your subscription starts automatically when the trial ends and the first payment is due then, unless you cancel before the trial ends.

If you haven’t chosen a plan, nothing is charged and the trial simply ends. Your records stay safe and your office staff can still view and download them, but new slips can’t be logged until you choose a plan. If you don’t choose one within 30 days, the trial is treated as ended under “Cancelling and ending” below.

4. Fees and payment

The fees are those shown when you sign up or in your order, and are payable in advance for each billing period. Prices are in pounds sterling and exclude VAT, which we add where it applies.

Monthly plans are paid by card. Annual plans can be paid by card, or by invoice payable by bank transfer within 30 days of the invoice date.

We may change our prices by giving you at least 30 days’ notice by email. The change applies from your next billing period, so you can cancel before then if you don’t want to continue.

If a payment fails, we will let you know and try again. If it is still unpaid 14 days after we have told you, we may suspend the service until it is paid. Your records are kept safe while the service is suspended.

5. Your responsibilities

The school agrees to:

  • only give access to staff who need it, and remove access when someone leaves;
  • make sure staff keep their sign-in details to themselves;
  • keep the pupil list and parent contact details accurate and up to date;
  • have a lawful basis for the pupil and parent information it puts into BumpSlip, and tell parents how it is used, for example in the school’s privacy notice;
  • check each slip before approving it to be sent to a parent or carer;
  • use the service lawfully and in line with these terms.

You must not try to get into other schools’ information, test or break our security, overload the service, copy or resell it, or put anything harmful into it.

6. Your data and data protection

The school owns the information it puts into BumpSlip, including pupil, parent, staff and incident records. Under UK data protection law, the school is the controller and we are the processor: we only use the information to provide the service and on the school’s instructions, as set out in our Data Processing Agreement.

The information is stored in the United Kingdom (London). Each school can only see its own records. We use a small number of carefully chosen suppliers to run the service (for example for hosting and sending email); they are listed in the Data Processing Agreement, and we will tell you before adding a new one.

Records are kept as a permanent log: slips are never deleted while you use the service, and changes after a slip is signed are recorded in its history. This supports your duty to keep accident records.

7. Availability and support

We aim to keep BumpSlip available at all times and to plan maintenance outside school hours where we can. We can’t promise it will never be interrupted, so keep a simple backup (such as a paper slip) for the rare occasion it isn’t available.

Support is by email at info@bumpslip.com during UK school hours. We aim to reply within one working day.

8. Our intellectual property

We own BumpSlip and everything in it apart from your data, including the software, design and name. We give the school a non-exclusive, non-transferable right to use the service during its subscription, for its own purposes.

9. Confidentiality

Each of us will keep the other’s confidential information private and only use it for the purposes of these terms, unless the law requires it to be shared.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow to be limited.

Apart from that, neither of us is liable for indirect or consequential loss, or for loss of profit, revenue or goodwill, and our total liability to the school in any 12 months is limited to the fees the school paid us in those 12 months.

We are not responsible for decisions about a pupil’s care, which remain with the school and its staff, or for problems caused by information the school puts into the service being wrong.

11. Cancelling and ending

You can cancel at any time by emailing us. Your subscription then ends at the end of the billing period you have already paid for. We don’t refund part-periods.

We may end or suspend the service if you seriously break these terms and don’t put it right within 14 days of us asking, or if we stop providing BumpSlip altogether, in which case we will give at least 90 days’ notice and refund any fees paid for time after it ends.

When the service ends you have 30 days to download your records (for example as CSV). After that we delete them from the service within 90 days, unless the law requires us to keep them. Please make sure you keep your own copy for as long as your records policy needs.

12. Changes to these terms

We may update these terms. We will email you at least 30 days before an important change takes effect. If you don’t agree, you can cancel before it does.

13. General

Neither of us is responsible for delays caused by events outside our reasonable control. If part of these terms can’t be enforced, the rest still applies. Only the school and we have rights under these terms. These terms are the whole agreement between us about the service.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
